Terms & Conditions

The agreement between you and Sahya Agro when you order our eggs, subscribe to our service, visit our farm, or use this website. Written in plain language to be readable, while remaining legally binding.

01Acceptance of terms

These Terms & Conditions ("Terms") form a legally binding agreement between you ("Customer," "you," "your") and Sahya Agro Organic Farms ("Sahya Agro," "we," "us," "our"), a sole proprietorship operating from Saloni Village, Narnaul, Mahendragarh District, Haryana 123001, India, holding FSSAI Central License No. 10019044001234 and NPOP Organic Certificate IN-ORG-XXX-2026.

By placing an order through our website, WhatsApp, telephone, or any other channel, by visiting our farm, or by using our services in any way, you confirm that you have read, understood, and agreed to these Terms in their entirety. If you do not agree, please do not use our services. Continued use of our services constitutes ongoing acceptance of these Terms, including any updates we may issue from time to time.

02Our services

Sahya Agro is engaged in the production, packing, distribution, and direct-to-consumer sale of certified organic eggs raised on our free-range farm in Saloni Village, Haryana. Our current product line includes Estate Brown eggs (Rhode Island Red), Pearl White eggs (Heritage Leghorn), and Omega Reserve eggs (Omega-3-enriched). We also offer:

  • Recurring subscription delivery (weekly, fortnightly, or monthly)
  • Bulk and wholesale supply to restaurants, hotels, caterers, and corporate clients
  • Custom-branded cartons for qualifying orders
  • Farm visits and educational tours
  • Newsletter, recipe content, and farm updates via opt-in email

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice where practicable.

03Eligibility

To order from Sahya Agro, you must:

  • Be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872 (or the equivalent in your jurisdiction)
  • Provide accurate, complete, and current contact and delivery information
  • Reside in or be able to receive delivery within one of our serviced regions (currently 283 Indian cities, 1,475 Haryana villages, and 56 Gulf cities)
  • Not be barred from receiving our services under any applicable law or sanctions regime

Persons under 18 may receive eggs that are ordered for them by a parent or guardian, but the contract for sale will be deemed concluded with the adult placing the order.

04Order placement & acceptance

Orders may be placed through our official channels: WhatsApp at +91 90917 92917, telephone, our website contact form, or in person at our farm shop. Each order goes through three stages:

  • Order request — when you communicate your intent to purchase. This is an offer by you to enter into a contract.
  • Order confirmation — when we acknowledge receipt of your request, typically within 2 hours during business hours.
  • Order acceptance — when we confirm dispatch with payment and ETA. Only at this stage is a binding contract formed between us.

We reserve the right to refuse or cancel any order at our reasonable discretion, including in cases of suspected fraud, payment failure, unavailability of stock, delivery to non-serviced areas, or breach of these Terms. If we cancel after payment, we will refund you in full within 5 working days.

The egg products we supply are perishable; once dispatched, an order generally cannot be cancelled. See Section 8 for cancellation and refund details.

05Pricing & payment

All prices are quoted in Indian Rupees (INR) for Indian customers and in UAE Dirhams (AED) or local equivalent for Gulf customers, and are inclusive of applicable GST or VAT unless otherwise specified. Prices may change at any time, but the price applicable to your order is the one quoted at the time of order acceptance.

We accept the following payment methods:

  • UPI (Google Pay, PhonePe, Paytm, BHIM)
  • Cards (Visa, Mastercard, RuPay) processed via Razorpay
  • Net banking for major Indian banks
  • Bank transfer (NEFT, RTGS, IMPS)
  • Cash on delivery for Haryana and Delhi-NCR only, on orders above ₹500
  • International cards & wire transfer for Gulf customers
  • Subscription auto-debit via UPI mandate or card-on-file

For B2B clients with established relationships, we offer 7- to 21-day credit terms based on volume and history. Late payment may attract interest at 18% per annum from the due date until paid, in addition to suspension of further dispatches.

06Delivery

Delivery times, charges, and conditions are governed by our Shipping Policy, which forms part of these Terms. In summary:

  • Same-day or next-day delivery for Delhi-NCR and Haryana
  • 2-3 days for Tier-1 metro cities
  • 3-5 days for Tier-2 Indian cities
  • 4-7 days for Gulf destinations

Title to and risk in the eggs pass to you upon delivery to the address provided, or upon authorised handover to a security guard, neighbour, or designated person at that address. We are not responsible for non-receipt where the customer has provided an incorrect address, an unattended location, or has failed to be available within agreed delivery windows after multiple attempts.

If a delivery is delayed beyond our control (logistics partner failure, weather event, civic disruption), we will notify you at the earliest and, where the eggs may be compromised, offer a free replacement on the next dispatch cycle.

07Subscription terms

If you opt for a recurring subscription, additional terms apply:

  • No minimum tenure — you may cancel any time after the first delivery.
  • Pricing lock — your subscription price is locked for 12 months from the start date. We will notify you 30 days before any post-12-month price change.
  • Pause and resume — you may pause indefinitely and resume by sending a single WhatsApp message.
  • Switching products — you may switch egg types or pack sizes any time; the change applies from your next dispatch.
  • Auto-debit — by opting in, you authorise us to charge your registered payment method on each scheduled dispatch date.
  • Failed auto-debit — if a payment fails, we will hold your dispatch and contact you within 24 hours. Three consecutive failures will lead to subscription suspension.
  • Subscription benefits — 10% discount, free delivery, no 24-hour reporting deadline for cracked-egg replacements, and 12-month price lock continue throughout the active subscription.

08Cancellation & refunds

Detailed cancellation and refund terms are in our Refund Policy. Briefly:

  • Orders not yet dispatched can be cancelled in full for a 100% refund
  • Dispatched orders cannot be cancelled but may be replaced or refunded for genuine quality issues, reported within 24 hours of receipt with a photograph (48 hours for Gulf, no deadline for active subscribers)
  • Subscriptions can be cancelled any time with one WhatsApp message; any unused weeks are refunded pro-rata

We do not refund delivery charges where the eggs themselves were delivered correctly, except in cases of our own delivery failure.

09Intellectual property

All content on this website — including but not limited to text, graphics, logos, photographs, video, audio, illustrations, lab reports, certifications, recipe content, and the "Sahya Agro" name and Dewdrop visual identity — is the property of Sahya Agro Organic Farms or our content partners, and is protected under the Indian Copyright Act, 1957 and the Trade Marks Act, 1999.

You may view, download, and print our content for personal, non-commercial use only, provided you retain all copyright and proprietary notices. Any other use — including reproduction, redistribution, modification, or commercial use — requires our prior written consent. Unauthorised use may be enforced through civil or criminal proceedings.

By submitting reviews, photographs, or other content to us (including on our social media channels), you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, and adapt that content for our marketing and operational purposes, with appropriate attribution where reasonable.

10User conduct

When interacting with us through any channel, you agree not to:

  • Engage in fraudulent activity, including using stolen payment instruments or impersonating another person
  • Place orders with intent to refuse delivery, dispute payment without cause, or otherwise abuse our refund and replacement policies
  • Threaten, harass, or use abusive language toward our staff, our farm visitors, or our delivery personnel
  • Attempt to gain unauthorised access to our systems, infrastructure, or customer data
  • Use any automated tools to scrape, copy, or extract content from our website
  • Resell our products without our prior written consent (B2B clients may resell as part of their food service to end consumers, which is permitted)
  • Use our farm visit programme for unauthorised commercial filming, photography, or media production

We reserve the right to terminate any customer relationship for breach of these conduct terms, and where appropriate, report criminal conduct to the relevant authorities.

11Disclaimers

Our eggs are raw, unpasteurised, agricultural products. Consumption of raw or undercooked eggs may carry inherent food-safety risks. We follow strict NPOP, FSSAI, and ISO 22000 standards to minimise these risks, and our monthly NABL-accredited Salmonella testing returns "absent" reliably. However, you should cook eggs adequately before consumption if you are pregnant, immunocompromised, very young, very old, or otherwise medically advised against raw or runny eggs.

Our website and all content on it are provided "as is" without warranty of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, or non-infringement. While we take reasonable care with all information published, we do not guarantee that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

Lab report results and certification numbers published on our website are accurate as of the date of publication. We update the website monthly. If you require the latest report for a specific batch, please request it through our official channels.

12Limitation of liability

To the maximum extent permitted under applicable law, our total aggregate liability to any customer, in any twelve-month period, in connection with these Terms or our services, is limited to the total amount paid by that customer to us during that twelve-month period. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, business opportunity, or data, regardless of the legal basis on which such liability is claimed.

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury arising from our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot lawfully be excluded under Indian law (including under the Consumer Protection Act, 2019).

13Indemnity

You agree to indemnify, defend, and hold harmless Sahya Agro, its founders, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms
  • Your violation of any applicable law or third-party right
  • Any misuse of our products by you, including but not limited to unauthorised resale or misrepresentation
  • Any content you submit to us that infringes a third party's intellectual property or other rights

14Force majeure

Neither party will be liable for any failure or delay in performing its obligations under these Terms where the failure or delay is caused by circumstances beyond its reasonable control. These include but are not limited to: natural disasters, severe weather events, pandemics or epidemics, civil unrest, war, terrorism, government action, port closures, regulatory changes, transportation breakdowns, large-scale courier failures, power or internet outages, animal disease outbreaks affecting our flock, and similar events. The affected party will notify the other as soon as reasonably practicable and use reasonable efforts to resume performance.

15Governing law & dispute resolution

These Terms are governed by the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, will first be attempted to be resolved through good-faith negotiation. If the dispute remains unresolved after 30 days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator mutually appointed by the parties.

The seat of arbitration shall be Gurugram, Haryana, and the language of arbitration shall be English. The courts at Narnaul, Haryana, shall have exclusive jurisdiction in respect of any matter not referred to arbitration. For Gulf customers, where local consumer law mandates exclusive jurisdiction in your home country, your statutory rights under that law are not affected by this clause.

16General provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement: These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and us with respect to your use of our services.

Waiver: No failure or delay by us in exercising any right will operate as a waiver of that right.

Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor entity without notice.

Amendments: We may amend these Terms from time to time. The current version is always available at this URL. Material changes will be notified via email and prominently flagged on the website for at least 30 days.
